Legal Question in Discrimination Law in Indiana

Got fired

On November 5, 2003 Myself and the APRN who was the action physican and 2 co-worker were sitting around at the front desk talking one of the co-workers was talking about how tired she has been, and the new diet she was on. the action physican was telling her she should see her doctor and get a check up, and told her to have me draw her blood. I told her I did not want to draw her blood, that I did not like to draw co-workers blood. the action physican said go on, draw her blood, so I asked the action physican what should I draw. she stated to draw a (Comp 14, Lipid panel, CBC) On November 7, 2003 HR came in to find out about the blood draw I had done on my co-worker.

If the action physican did not give me verbal orders to draw her blood then why didnt she confront us when we went to draw the blood in room 2 with the door open where she could see everything that was going on. She was sitting in the front. To say I did not have written orders to draw blood on a co-worker, is why I am being fired is not right! That is why I feel my co-worker and myself has been setup by the action physican and the other co-worker. And on November 14 my co-worker and myself was fired for drawing blood without a written order.

Re: Got fired

I glean from your question that the action physician is denying telling you to draw the blood. If so, and if there is evidence that the action physician: (1)is biased against you because of your age, race, and/or sex, etc; and (2)was involved in the decision to terminate you from employment; you may have a claim for discrimination. You have 180 days from November 14th within which to file an age claim. 300 days for the other discrimination claims. Please feel free to contact me if you would like to discuss having this firm evaluate your claims and, possibly, represent you.
