Legal Question in DUI Law in Indiana

DUI 8 years apart

I was convicted of 2 DUI's in 1995..... I just got pulled over for one yesterday. How will this affect what happens in court? I have heard that if there were 5 years between them they can't hold the previous ones against you. Is this true?

Depending on the date of the last conviction, you might avoid this being chrged as s felony. Yet, all prior convictions are considered in resolution of another offense. This is particularly so in the case of DWI. The state usually feels it must and if convicted of the most recent charge, the court may and will consider it for purposes of sentencing. If convicted, it may also result in loss of your drivers license for 10 years. This could also result is some jail time. The bottom line is that there is still a lot at risk even if it is not charged as a felony. If conviction can be avoided, it should be. Retain counsel ASAP.
