Is it legal for the hospital to draw blood from an accident victim, if they had major head trauma ? I don't what reason, other than proving DUI, they would have to draw blood.

If requested to by law enforcement, yes. A blood draw would be expected in any trauma situation; they have to know what drugs are already there, if any, before they start administering any.
