Minor Consumption Charge in the State of Indiana

My son is 19 and back in Nov he had a public intox charge in another county which has been taken care of. Two days ago he hit a deer with his car and the officer smelled alcohol on him. He blew a .04 which i below legal limit but because hi is under the legal age they charged him with minor consumption. With the 2 charges being so close together should we hire a lawyer?? He has done cummunity service took alcohol classes and paid fines with his first charge in the other county. Please let me know what you think we need to do for this charge. Thank you for you time. I didn't know what area of law to put this under since he really was not driving drunk he was not charged with a dui.....????

Any time a person gets 2 charges so close together the chances of going to jail substantially increase. Especially when the 2 charges both involve alcohol. I think it would be a VERY good idea to hire an attorney for this new case.
