What do I do? I have a previous DUI from when I was 19 in another state. I am wondering what will happen now, whether I should have a lawyer and what my possible punishment may be?

If you currently have a DWI (DUI) pending with a prior, you would be well advised to secure the services of an attorney as soon as possible. How the prior may impact your case will depend on a variety of factors. Depending on the length of time which has passed, the current charge may or may not have been filed as a "D" felony. Another factor may be where or what county your current case is pending. Along with this will be the particular facts of the current case which will influence the strategy to be employed in advancing your defense and interests. If you have a prior OWI in any state, it can affect the outcome of your current case by making you eligible to receive a harsher sentence, including mandatory jail time and license suspension! You need an attorney for ANY OWI, but especially if you have a prior record. If you are charged with a misdemeanor you are facing up to a year in jail, and if it's a felony up to three years in jail.
