Legal Question in DUI Law in Indiana

Roommate's probation terms

My roommate got a DUI about a

month ago and recently had her

court hearing. She is saying that we

cannot have any alcohol in any

common area of the house. How

does this affect myself and my other

roommate (who aren't in any

trouble). We are 23 and 24 and have

never been in trouble with alcohol.

Does her probation mean that we

can't even have (wine glasses, cups

of beer) in ANY common area? Or

does that mean that the containers

must be in our rooms? We are trying

to figure out if this will affect us in

having our friends over for drinks in

our living room or basement or

porch, even if the other roommate

isn't involved? Do we have to confine

our drinking to our bedrooms?

Re: Roommate's probation terms

Only the probationer is affected by this order. You have no obligation.

In the unlikely event of a visit by her probation officer, it's possible that she'd be violated if there was alcohol in the common area, but as a practical matter, only if she had been drinking.

You might help her by keeping the alcohol in your rooms when not partying.
