Legal Question in Education Law in Indiana

Free reading?

In IN Law, General Powers Act, Code 20-5-2-2(11), it says that a school district can either give free book rental or charge. Here, they charge. If the parents don't pay up by the time of graduation, they get hauled off to Sm. Claims Court.

My mother was a secretary in the District a few years ago and while typing up minutes to a Board Meeting, she heard on the taped session a Board member say as an aside that he believes book rental fees are unConstitutional and has 'NEVER paid these fees for my children.'

This person is now the Board President and I am positive that when his kids graduated, he was NOT taken to Court and enforced to pay....and if he's not, then why are everybody else's parents? If he has kids still in school, I'd bet that he never has been or will be harrassed or forcefully required to pay them either....because that's the ''way'' of our Board.

Can this situation be investigated? If what he said is true, this is not fair to the rest of us. Since he should be exemplary, he should be called on it. Thanks.

This sounds like perfect fodder for your local newspaper.

Individuals and entities can pursue whatever legal claims they choose.

Is the situation you described fair? No. Is it legal? Probably.

I think your paper would be interested in exposing this double standard, however....
