tort claim on school
should i send my child back to school if they are emtionally and not proparly educating him and if i have the tort claim. and the judge wants me to apeal i the iep to send him to another school , and there is nothing wrong with him going somewere else other than theschool

This is something that should have been worked out BEFORE getting involved in litigation.
If you have a tort claim and you send the child back into that situation, what message does that send the child?
The IEP can be facilitated with the school at no cost to you. If you don't know how to get that sort of help, contact the school board and ask for an "IEP Facilitation." If you don't have a program in Indiana, then look up the resources in Michigan,--someone can probably come down.
This facilitation will help all parties agree to do what is best for your child. Even if you've had no success in the past, a good trained facilitator can help both sides work things out really well. You'd be surprised.
I doubt the judge expressed any opinion on what you SHOULD do, but you need legal counsel with expertise in education law.
