Legal Question in Elder Law in Indiana

My mother passed away 2-10-06, and I have asked the bank for her bank statements, because 2 certificate of deposits are missing. My ex at the time began finagling and was successful at obtaining POA for 2 months. My mother had full blown Alzheimer's. Later I did retain a restraining order against him. However, I need those 2 months, but the bank is refusing to give them to me since I didn't have POA. I gained POA back after going to court in May, 2004. Can I report this? The missing CD's? I'm not sure where that money is, possible my ex put it in his account. I'm talking with the attorney who was handling my mothers account from May, 2004 - February, 2006 and he has not gotten back to me.

This matter requires the services of an attorney. Go to a new law office if your present one isn’t responding. A proceeding can be filed with the court, through an attorney, to demand an accounting of transactions while someone acted a a P.O.A. Problem eventually is how to collect any missing money. Even if you obtain an accounting and perhaps judgment against your ex,you may never see a penny anyway. You have to ask yourself whether it’s worth the legal fees to chase this.
