Legal Question in Family Law in Indiana

If my 3 children are in Foster Care how could I get them back?And what age do they have to be to verbally tell a judge they wanna come live with there biological parents.Also what age or criteria does a child have to be in order be emancipated?There ages are 14,8,and7 years of age..Please HELP me and guide me in the right order...

Your children were not placed in foster care in a paragraph, and getting them out will take more than a paragraph of information and advice. You really need to go see an attorney and explain the entire situation to him or her to answer your question. BTW, children are never in charge of where they live. Once they are 18 they can decide, but under the law they are not children anymore. A parent should never want to see them emancipated before then.

If the grounds for the placement no longer exist you may be able to petition the court. However, the process and the factors involved are far too complex for this forum. I have previously posted the criteria for emancipation. Please review my prior answers from the LAw Guru data base.
