Legal Question in Family Law in Indiana

i am 17. i am turning 18 in april. my brother is already 18 & in the army. my mom moved out of our house with her boyfriend & we are living with out step dad. my mom is my only legal guardian. my birth dad lost custody when i was less than 2. i'm not sure why. my birth dad is telling me since my mom moved out she can be charged with abandonment & i'll have to move with him in nebraska. he says that since she doesn't live with me anymore custody will default to him. i need to know whats true, whats lies, & what could happen?

Unless his parental rights were terminated, your father could petition the court for custody. You are close enough to 18 that by the time he does it, it probably will be a moot point. I am sorry about your mother and her immature actions. Good luck.
