Legal Question in Family Law in Indiana

I have a 26 year old daughter (adopted at age 10). At age 20 she married a man who is an illegal immigrant to the US. They split up a couple of years later but never formally divorced. Now she is unable to find him. There is a strong possibility he was deported. I found court records that indicated he was in jail on a drug crime and was handed over to INS.

My daughter is now very sick and not expected to survive. Am I going to have any problems with making funeral/burial arrangements since she is legally still married? She has no property, money, or children, so this isn't about inheritance. I could ask her to make a will but at the moment she's in denial of her health situation and resists doing that. Thanks for any advice.
