Legal Question in Family Law in Indiana

My ex of 8 years is refusing to allow me to enter our shared residence to obtain the personal property of mine and our childrens. I left almost 3 months ago after the police were called (again) for him putting his hands on one of the children. I didnt file charges because the officer talked about Division of Family and Children, which I did not want to be involved with. Can I file small claim to get back my personal property? What steps do I need to take in order to get these items being that he has everything including clothing and everyday needs. I am now raising the 4 children by myself and can not afford to repurchase clothing for winter. I can not call the local police due to him being an officer, in which the officers in our town seem to side with him, and I am rushed to get my things. (This has happened previously) We do not agree on what is his what is mine.

You situation is an example of why non-married couples should have a cohabitaiton agreement.

Please visit www.todayslawalert.com. That being said, you can file a suit for the value of the items in Small Claims Court.
