ok i have a 3 yr old son and his dad and i were never married and we split up and i filed a protective order against him because he was stalking me. its been a yr and now im moving out of state and i was wondering if i dropped the protective order and just left if he could get me in trouble. he was told the first court date to prove paternity and he never did it and custody has never even been discussed. james, my son, has lived with me his whole life...

If the alleged father did not sign a paternity affidavit and has not established legal paternity by a court order, there is no reason why you cannot move.
