Abondonment

I need to know if I leave my marriage, to move to a different state, before filing for divorce and I leave my 5 year old son with my husband, who is also his biological father, if that would be considered abondonment and/or anything illegal. I need this information A.S.A.P. please. Thank you.

Your anticipated move may have an impact as it relates to custody. If this move is based on fear of violence, there are agencies and organizations in the state which may help. You may even be able to your five year old with you.

Should you leave with out any contact information, it could work a disadvantage for you.

It may not be illegal to leave your son if he remains with his other parent, but I would think you would consider the impact it might have on your child in other respects.
