What are the actual rights of a 17 year old?

My son is 17 and lives with his mother who is the custodial parent. I cannot afford an attorney to assist in regaining full custody. I have encouraged him to remain with his mother until my financial situation changes. But he runs away and comes to my home. I want him here but am gravely concerned he will create severe difficulties for himself with the law. How do I advise him and how, in your opinion, will the police view him at his age? He will be 18 in 8 months.

As the non custodial parent it is your obligation to get him back to the custodial parent. I can not tell you how the police would view this. I suggest that you visit your local police department and ask to speak to someone to discuss the situation. If nothing else, they will be aware that it is not truly a run away situation.

Also, your child is 17, old enough to know better. You need to sit with him and explain that there are ramnifications. You might also try meeting with the custodial parent. She may be fed up with the child and be willing to enter into an agreed order.

Also, if you are near a law school, some of them have discount legal fees available through their legal clinics. Something you should look into.
