Legal Question in Family Law in Indiana

If I add my spouses name to my deed and we divorce will he be entitled to half the equity in my home since I am the one who paid for the home. I have owned the house for 15 years and paid it off 2 years after out marriage.

There are a number of factors that a court reviews when dividing assets and debts. There is a chance that he is entitled to half, and there is also a chance that he isn't. You need to hire counsel to review the entire marital estate so that an opinion can be provided based on all of the facts.

Adding your spouse's name will be just one factor, but it is possible he will share in the equity in the house (not necessarily 50/50) regardless of what you do because Indiana law includes a solely owned home as marital propetry and you did not have (apparently) a prenuptial agreeement. See a family law attorney in your area if you would like to try to protect your assets now in case of a divorce later.
