Legal Question in Family Law in Indiana

Adoption of a child without parent consent.

I have had legal guardianship of my niece for 3 years now. It has been almost to years since she has seen either parent. Now out of no where my sister wants her back. At this time I am in the process of adopting my niece. We have petitioned the court to waive parental consent to the adoption due to the length of time it has been since either parent has had contact and the fact that neither parent has ever contributed any support. What are the odds that the judge will rule in our favor?

Re: Adoption of a child without parent consent.

This is too complex of a situation for a simple answer. However, if a biological parent is contesting the adoption you should hire an attorney asap.
