Adoption by step-mother

I'm wanting to adopt my step-son. My husband was told he had a son when the child was 10 months old and got custody when he was 11 months old. We haven't heard from the biological mom since February. I know I can file for the adoption myself, but I have a few questions.

How long do we have to be married before I can adopt the child?

Where do I get the necessary forms for the adoption?

Generally an adopting step-parent must be married to the natural parent for at least one year before a court will grant an adoption. While there are no "standard" forms for adoption, the statute spells out the requirements of a petition, as well as the findings that a judge must include in the order (which you or your attorney will prepare). If you do not wish to consult a local attorney for this matter, at least discuss this with your probate judge about the procedure you must follow.
