Legal Question in Family Law in Indiana

appealing denial of permanent guardianship

We had temporary guardianship of our two nieces until yesterday. there was a guardian ad litem on the case who did not follow through with his obligations and did not submit a report for the judge nor did he contact the state of Alabama where there is another case pending regarding a 3rd child. The judge on our case said we did not prove the mother as unfit but we feel that if the guardian ad litem had done his job that would have been proven. Do we have a case for an appeal?

Re: appealing denial of permanent guardianship

You may. You may not. You will need to order a copy of the hearing transcript ASAP and hire an attorney to review the transcript and the evidence to determine whether there was an abuse of discretion. There are very strict time limits, so you need to so this NOW.

Good luck.
