My baby's last name

I am having a baby with my ex girlfriend and we are not together and have no intentions on being together. What is the legal standpoint on his last name. Is it a matter of choice whether or not he gets my last name? Can the mother legally not give him my last name and just give him her maiden name? Even after we have a paternity test done proving that he is mine, what are the options for his last name?

If you and she can not agree, you will need to file in court to establish your paternity, parenting time and child support. As part of that proceeding, the name can be determined. Usually, the fathers last name is given, although that is not always the case.
