Legal Question in Family Law in Indiana
Back Child Support
I have a 6 year old son whom my husband is adopting. I want to know if I can go back and try to get ''back child support'' from my ex once the proceedings are finalized. The whole reason I have not went after child support before now is because I did not want my ex to have visitation rights or anything of that nature (he's into trouble with the law a lot) He did not sign over his rights, it was announced in the local paper and he was given 30 days to respond to the adoption proceedings. Legally, can I go after back child support for the past 5 years even though he is not named on the birth certificate?

Re: Back Child Support
You have every right to collect child support from the time the support order was entered up through the date of adoption. However, if you have an address at which the parent can be contacted to begin support proceedings, you probably had the address for him to be actually notified of the adoption proceedings and don't be surprised if he seeks to have the adoption set aside for improper notice.
