Help with bills

My husband moved out in January. He 1st left a note saying he would help me out by giving me $400 a month. Then 4 weeks later when i found out he was and had been seeing someone, he said he wouldnt. I havent recieved any monies from him at all. The attorney i have seen said i can file for divorce and they can file a paper that makes him pay me something each month.

My question is. I dont want a divorce. Can i file this paper if i just file for a legal separation. I am not working and havent since last April and i need some help with the bills.

You have the right to file for a legal separation and have the same rights as during a dissolution proceeding (that is enforcement of an agreement for support). It is difficult for some attorneys to understand that you want the legal separation as opposed to the dissolution and most of them will discourage you from the legal separation. You must also realize that if you file for a legal separation, your spouse can file a counter- petition seeking the dissolution and that any order entered by the Court will expire after one year.
