My brother just recently broke up with a girl who he had a child with and she is refusing to let him see her, they have not been to court to determin custody yet, but does he have any rights as of now to get his daughter?

Yes, he has rights, which will be spelled out when he goes to court, assuming he requests custody and/or parenting time. Ther is no piece of paper he can go get now AHEAD of the court hearing which will be enforced against mother before or without a hearing in court.

He has no rights as of now to enforce against the mother. He need to file for paternity and once he does so, set the matter for a hearing as soon as possible so that he can establish his rights.
