Legal Question in Family Law in Indiana
Building house/Getting divorced
My husband & I are divorcing(not filed yet). The house we are building is about 2 months from completion. He says he will not sign the note when the house is done and I can't get a loan alone as I only work part time right now. It is being built on property that is in my name ONLY. I aquired the lot (while married) from my mother as a token of appreciation for being her caregiver for the final 5 years of her life. What options do I have other than selling the house and splitting the profit with him(I own the lot free and clear)? He insists half of the lot is his because we are married even though it is in my name only. I would like to be able to keep the house so our 3 children have a nice home to live in. I'm trying to find a better job and hope that between that and any child support I might receive, I will be able to make the payments. Any advice will be much appreciated.

Re: Building house/Getting divorced
I suggest that you contact a lender and determine whether a new job and child support would qualify you for a loan. If not, your best bet is probably to place the home up for sale right now. You should consult with a lawyer concerning whether the lot is considered to be property of the marriage since it was your mothers. There may be other factors that will come into play also. Your circumstances are too complex to be properly addressed in this forum.
Good luck
