Name Change

My qustion is that I have a child out of wedlock and my child lives with me. His father signed the birth certificate but paternity has never been established because we both know he is the father. But now my sons father and I are no longer together because he got physically abusive with my son and I as well as he has threatened to kill both of us. Well his father is now in jail and has not seen him in ten monthes nor has he paid child support on him either. I have never taken him to court because I am afraid if they would ever give him unsupervised visit and I want his name to be changed to my last name. How likely is it that I can get this done?

The question is not wheter he signed the bc. Did he sign a paternity affidavit? If not, you may be able to take care of this administratively with the Indiana Department of Health.
