i want to change my 5 year old last name to his fathers that i am married to. but he is not on the birth certificate

If the question is "How do I do that?", you can file a petition for name change, notify the child's father, and then see if the court will allow it. But, since, the only reason to do this is to pretend that your husband is the child's father, why aren't you asking aboout adoption?
