Chid - Divorce

My son is 17 and want to come live with me. He turns 18 in Aug. 2008 His senior school year would start the first of Aug. Can he just leave his father at 17 or will he have to wait until he is 18? Can this happen without the courts being involved/ His father don't care one way or anothre!

No, he can move but you will still need to file a modification with the court and get a court order changing custody.

he can move out. However, you should get a court order for two reasons that come to mind. One, is that the father could change his mind, especially if you decide to claim your son on your taxes. Secondly, there needs to be an order that modifies child support. You can not change child support without a court order and not run the risk of being held in contempt of court or having a tax intercept done. You should contact an attorney locally who can explain these concerns in more detail than this forum allows for me to do.
