Legal Question in Family Law in Indiana
Child Custody
I got a divorce in California and currently live in Indiana, my ex-husband has not paid child support from day 1 (approx. 4 or 5 years now). Recently he told my son that if he moves in with him he will make sure that he is taken care of and will get to do everything he does with me. My question is this, I have full custody of my son who is now 13, do I have to allow him to move in with his father? Can I file any kind of paperwork removing his parental rights since he has never paid child support in over 4 years?

Re: Child Custody
You really need to discuss this with an attorney in California as the decree was entered there and to determine what California's stance is on the Uniform Child Custody Act. Further, you should file for a contempt due to his failure to pay child support. Depending on circumstances and in particular California's interpretation fo the Act, you may then wish to have an Indiana lawyer review the matter.
