Legal Question in Family Law in Indiana

child custody

I am the non-custodial parent of two girls and they live out of state. Their father is currently applying for disability and hasn't been able to work in three years. He is taking some very strong prescriptions. He also has great difficulty getting around. My seven year old daughter is having a lot of problems at school. Is there anything i can do to improve my daughters situation.

You will need to file a petition to modify support and must go back to the Court where the custody was originally decided. If the custodial parent out of state moved from Indiana during or after the custody case in Indiana, then the Indiana court that decided custody will have jurisdiction. If the out of state court made the decision and he still lives in that state with the children, then that court will have jurisdiction. If neither of you still resides in the state where the original custody decision was made, then either the original court or a court in the state where the children reside would be the appropriate forum. Once a child has trouble in school that is an indication to the judge that the child is having trouble adjusting to his or her community.
