Legal Question in Family Law in Indiana

child custody

I need to know my rights to Change of Venue, and Due Process. My ex-wife filed a protective order almost 4 years ago, and prevented my contact with my 2 minor children. I made repeated requests to the court for a hearing in hopes to exclude the children so as to re-establish visitation. My ex- wife has since died, and her former husband was granted temporary custody, and replaced as petitioner on the P O. I recieved no notification of the death, or other proceedings until after the fact. I am now working with an attorney that will not demand my DUE PROCESS be respected. I do not know what to do.

Re: child custody

There's a lot of information you don't disclose regarding the protective order. Depending on the basis for the protective order, and you are the paterinal father- you don't need a change of venue. You need to file for modification of custody. If you wish to discuss further, feel free to call or email our office.

Re: child custody

There are not enough facts provided to discuss your due process rights or a change in venue.
