My sixteen year old daughter has been told she is now old enough to stay with her dad no matter what I say. The situation is not a good one at her dads. Does this have to go through the court system first?

This must go through the courts if you choose to contest her choice. Someone is giving your daughter incorrect information. However, at her age, the court gives her desires significant weight when considering a petition to modify. You should contact an attorney to discuss things in more detail.
