Child Custody

My son lives with his mother in Indiana while I live in Texas. My son is 16 years old and is smoking, drinking, engaging in sexual activities and doing drugs. He is also failing 10th grade with 3 F's and 2 D's. As the non custodial parent, what are my rights? I want to bring my son to Texas where I can enforce discipline and help him graduate high school. My ex-wife wants to pull him out of high school, get him his GED and let him start working. Help!

You should hire counsel and file a Petition to Modiufy Custody. Expect an expensive battle if your son does not want to come live with you. At his age, his choice is given a lot of preference. However, the bottom-line is what is in the best interest of a child, and it does not appear that he can thrive where he is at.

You have several grounds to file a motion to modify the SAPCR in place and get your son here. The question is, where was the last order entered?
