Legal Question in Family Law in Indiana

Child being disciplined

My son petitioned the court for joint custody of my grandaughter with primary residence with him. Her mother agreed with the petitioned and it has since been filed and finalized. Her first visitation with her mother was this past week. When my son called to talk to her daughter, he heard her mother's boyfriend in the background spanking his daughter. Is there anything he can do?

Re: Child being disciplined

He can have his attorney write a letter to her attorney (or to her directly) if she represented herself and point out that any corporal punishment of the child would need to be administered by the mother, not a third party, and that if mom and boyfriend were unwilling to comply with that request that dad will be going back to court to ask for an order to that effect and/or for a change in custody.

Re: Child being disciplined

Make that a change in visitation (not custody). I reread your post, and he already has custody.

He can request that visitation be supervised.....
