Legal Question in Family Law in Indiana

is a child of 10 able to speak against a father that was verbally, physically assualted his mother and had to flee home at 1230 at night have to go to visitations or does he have the right to decline due to fear. This child was denied by this man for 10 years. There were many occassions that the man would say "the child is not mine" and these statements were made at a time when the child could hear it. In a nutshell can a 10 year old decide if he wants to visit or contact a father?

In a nutshell no child can be the absolute decider on whether there is visitation, regardless of age while still a minor. A judge can consider the things that you have said and deny visitation or require supervised visitation or make no changes, depedning on the evidence.
