Legal Question in Family Law in Indiana

Child Support

My ex is behind in his support and would like to buy a house. He cannot get financing. He is paying extra every week to catch up on his back support and would like for me to agree to wipe out the back support that he owes and he would up the amount he gives me every week. Is this something that is possible?

Re: Child Support

Depending on whether you have been on AFDC, you can agree that the arrears are paid in full with a modification to a higher amount of support. Remember, once you agree that there is no arrears, you cannot go back later to seek collection. Depending upon the amount of the arrears, perhaps if he gets a loan to pay them off or is able to borrow enough money to pay up as well as buy his house, this would solve his problem. Occasionally there is a problem with the court approving any support modification that is not the particular guideline amount.
