Child Support
My ex-wife is taking me back to court to have the support for our two boys raised. I am concerned that the courts have told me that her va-disability is not to be considered as an income in figuring the support payments.Currently my income is not much higher than her disability income but she is considered to have no income and all support will be figured on her recieveing a min wage. Is there any way for me to get the court to recognise her disability income /

The Indiana Child Support Guidelines specify what types of income are considered or ignored for computing child support. If her income is treated as a "means-tested" income it will be ignored or excluded from the computation. If her VA pension is for a disability and not dependent upon other income in her household, then it will be considered as her income. Both the Indiana Supreme Court and Marion County websites have copies of the child support guidelines on line so you can read them.
