Child Support

I have lived with my boyfried for 4 yrs. His ex-wife is taking him back to court for more child support, and her lawyer wants access to my income tax papers for the last 2 years. Do I have to let her see them? They are going to court on April 13, 2004 to request the info. Should I get a lawyer of my own?

The theory the ex-spouse is using is that your boyfriend is sharing expenses with you by you residing in the same household as he is (the same as if you married) and that he benefits by having more disposible income to devote to child support. If he is employed full time, then your separate income should not be a consideration. If he is working less than full time because he in part relies on your income to get by, then the judge might well find it reasonable to know what you make. If there is no question of imputing income to a full time employee, then you should move to quash any subpoena directed to you for your income.
