Child support and Taxes

my child is 18 and not in school. I went and made arrangements to pay my back support and to stop current child support. This has gone through court and has been signed by a judge. My question is can the state still take my state and federal income taxes or am I entitled to them now that arrangements for repayment has been made?

That depends on whether you owe back support or not. If you owe money to the State of Indiana, they can certainly keep your tax refund.

The tax intercept program kicks in if you are more than $1000 in arrears. This is independent of any court order. However, you can protest the the intercept, show them the payment arrangements, and they may consider releasing the intercept. If they wont, you need to make sure that you deduct that amount from the arrears and once you are caught up, get a court order that reflects your current support without the arrangements. good luck
