Child Support Termination Procedures

My daughter is almost 21 y/o.

She is ''emancipated'' (Her Moms words, not mine), living on her own, working and going to college.

I am confused about the actual cut off date, is it 21 or 23 in Indiana?

I do want to continue contributing financially. But I prefer it not court mandated b/c of maitenence fees, her mom, etc.

My first question is, can I discontinue court mandated support since she's ''emancipated'', but still in college.

And assuming the cut off date in Indiana is 21, do I need to file anything with the court or just stop paying after her 21st b-day.

Emancipation is a legal term and can occur at age 18 (or even sooner, depending on circumstances). Sometimes, a child may go on to college and the non custodial parent will have to pay a portion of the college tuition.

You need to file a Petition for Emancipation. If the Court wishes, it can order that you pay a modified support in the way of some of her tuition, as well as some support when she is home with mom. But you have to file with the Court.
