Child support

I have a 2 year old and a 7 year old who has Autism, my husband pays backed child support from his first wife, that child is 19 but as I stated he is paying backed payments that equal 12,000.00. My husband makes 80,000.00 a year and I want to know what my children would be entitled to. We have been married for 10 years this year. I have been an at home mom and take sole care of my autistic child.. Please let me know if you need anymore information to give me a calculated guess as to my rights. Thank you, Barbara

Your rights are for child support. You may also have maintenance rights. The maximum that you could possibly be entitled to is 1/2 of his gross under Indiana law. However, that is not likely since he has back support that he is paying. My guess is that you could get up to 1/2 of his gross less the amount of support already being paid. The extent of the autism would have an effect on how much and for how long you might get maintenance.
