Legal Question in Family Law in Indiana

children

If I were to die and I have minor children would they automatically go to there father. Do I have to have a will to cover this. There has never been a marriage and I am listed as sole custody.

If he has been legally determined to be the father, absent exigent circumstances, he will get custody.
