Can My children & I move back home?

I want to know if there is anyway my children & I can move back into the our house until the divorce is final. I we are currenly living less than a mile down the road with my parents in their home. It is crowded, and very difficult to live under these circumstances. The house is in my husbands mother's name.

Have your attorney petition the court to get you back in the house.

Yes, you can obtain a provisional order allowing for you to have temporary possession of the home. The court looks at what is in the best interest of the children. However, since the home is owned by your mother in law, if there is no lease, she could give you notice( the amount depends on the circumstances) and require that you move out. However, the court could also order that he pay additional living expenses.

BOTTOM LINE: get an attorney. If your husband makes substantially greater earnings than you do, the court may order him to pay your attorney's fees.
