Legal Question in Family Law in Indiana

I have two children 6yrs and 9 yrs.. Their father and I have been divorced for 4 yrs due to his crimnial behavior and drug use. He was convicted of 3 felonies and incarcerated for 3 years due to these actions. My question is I have concerned that he is exhibiting the signs that he may be using drugs again.. If there is a time that he picks up the kids and I feel he is under the influence am I required to entrust him with the kids?

Unless there is a restriction in the parenting time order, you are legally required to turn them over. However, legal and common sense sometimes are not the same. You should contact your local attorney to see how the judges in your county view this kind of situation.
