College Expense

I have 2 children that will be going to college within a year of each other. Can the courts award them 1/3 payment of their college costs even though I cannot afford it? I also heard that if their mom does not petition the courts within 6 months of graduation of the intent for college, then she won't be able to petition at all, is this true?

If the court finds that you can afford the costs, then you will have to obey the court's order.

The custodial parent can modify the court's order up to the time that the children are emancipated or turn 21. So the six month's thing is bunk.

She can petition until each turns age 21. There is a myth that the amount of college contribution is always 1/3rd. It is based on both parents and the childs ability to contribute.

However, there is no requirement that the contribution is equal.
