Legal Question in Family Law in Indiana
contempt of court and abandonment
I moved to Nebraska from Indiana, June 2004. Twins involved ages 16. Prior to move kids upset agreed with father trial time in NE & IN. They do not get along. I thought this fair for all. Kids have never stayed one full week prior to this since 1992 with their father. Two weeks later I talked with daughter who returned to Ne with me June 1. Her twin brother stayed to visit my sister. June 27 he also returned with me to NE. No support received month of July when I went to check their father had wrote a letter to the court June 29 that I had abandoned my kids left no address where to be reached and lied to get support stopped. In June I had talked with step mother and gave her both. I filed a letter in court telling what happened and asked for modification of support and that their father lied of not knowing my whereabouts. Judge sent me letter for Modification and Contempt. His wife wrote me a letter saying they needed the money for their personal financial problems. His wife wrote another letter lying to Judge and said I came back August 5 to claim my kids and start support back up. Judge ordered custody back to me and no child support has been recieved since July 9, 2004. What actions of recourse do I have?

Re: contempt of court and abandonment
Since you have a custody order, you can return to Indiana for contempt hearings on support, or you can get certified copies of your Indiana order and contact your local child support collection agency and have the matter referred by them to an Indiana Prosecutor for enforcement, which means you would not have to appear here for a hearing.
