Legal Question in Family Law in Indiana

Contempt fees and arrearages

If my ex owes me money for a contempt charge she recieved for interfering with visitation will I be able to collect those fees even though I will have arrearages in support? Her attorney want the fees to go to the arrearages but of course I want her to pay them directly to me because it seems like if she doesnt have to pay the fees she didnt really get in any trouble or have to do anything for her contempt. so I guess the question is really will the judge most likely take those fees and apply them to arrears? Is there anything I can do o make sure this does not happen?

Re: Contempt fees and arrearages

With all due respect, I would be very happy if I were you to have the arrears reduced. It is unlikely that any judge is going tpo require her to pay you directly when arrears are owed. Further, you take a major risk of alienating the judge by asking for a direct payment. Since it is clear that the two of you are still fighting an ongoing battle, you are probably going to be in front of this judge again. Think of this as a war not a battle. You do not wantto weaken your ability to win the war by using up your resources on a single battle.
