contested adoption

My youngest child born out of wed-lock. Biological father in our lives 1 1/2 years from the time child was born. Biological father breaks the law on several occations for burglary, breaking and entering, resisting arrest, breaking restraining order; I am the victim. He was sentenced to serve 4 years in prison, he ended up serving only half due to good behavior. While he was serving time, I met my husband. He has been in childs life a total of 2 1/2 years today. Throughout biological fathers prison term, he has made no effort in communicating with child, my husband wants to adopt her and I agreed that would be the best. We were interviewed by The Division of Family and Children Services and they documented to the courts that they approve this adoption. Biological father is contesting the adoption. Any input? Thank you kindly!

He has a right to contest; whether it does him any good or not will be entirely up to the court.
