Continuance for child custody
Hello, My ex-wife filed for modification of custody and the court date is in 3 business days. I need more time to make it to the courts and need to file a motion for continuance. How do I file this form, or is it too late to file this? If so, what can I do to request a continuance according to Indiana law.

You can try to talk with her attorney and if he or she agrees you need to notify the court in writing. If he or she do not agree, you need to file a formal request to the court with acopy to her attorney. Although it is a bit on the late side, if you give good reasons such as you need to hire an attorney, most courts will grant it. Go to the Indiana Judiciary Website. There may be forms there, I don't recall if they have one for a continuance, You also need to read over the Indiana Trial Rules and the Local rules for the county where the case is being heard.
