Legal Question in Family Law in Indiana

I have a court order, from 2008, that states the non custodial parent can claim my daughter who lives with me all year. He does less than minimum parenting time allotted and has violated the court order in many ways himself. He is paying support only because unemployment is. She is 5,and I feel very strongly that he is using her as a paycheck. He also is claiming another child he had that is 2. Why can't I claim my child? Do I need to bring this back into court?
